How do I claim an exemption?

To claim an exemption from jury service, you must complete the jury summons form or send a letter referencing your court date and time, and return it to the College Station Municipal Court prior to the date you are summoned to appear. Please note that business and personal reasons are not qualified exemptions. The following persons are exempt from jury service:

  • Person over the age of 75.
  • Person having legal custody of a child under the age of twelve only if jury service would necessitate leaving the child without adequate supervision. If you are employed full-time and your child attends school/day care, you are not entitled to this exemption.
  • Person enrolled and in actual attendance as a FULL-TIME student in an institution of higher education.
  • Officer or employee of the Senate, House of Representatives, or any other department, Commission, Board, Officer or other agency in the Legislative Branch of the State Government.
  • Student of public or private high school.
  • The primary caretaker of a person who is an invalid unable to care for himself or herself.
  • Not a resident of the City of College Station.
  • Not eligible to be a registered voter.
  • Have been convicted of theft or any felony or under indictment or legal accusation for theft or any felony.

Note: Any person filing a false claim of exemption can be punished by a fine of up to $1,000.00.

How do I request another court time?

Send in your jury summons or a letter requesting another court date/time. The Presiding Judge will review the excuse and approve or not approve such a request. You must call court staff after 48 hours to check on the status of your request.

What happens if I don't appear for jury duty?

You can be punished by a fine of $100.

Pretrial Conference

This is a mandatory conference between you and Assistant City Attorney (prosecutor) at which time you will have an opportunity to discuss your case. If you do not reach a plea agreement approved by the Judge, you will have to decide whether you want your case to be heard by a Judge (Bench Trial) or a jury (Jury Trial).


Motion for Continuance

If you are set for a pretrial conference, bench trial or jury trial and you want to request a continuance, it must be presented to the court in writing by certified mail, or in person at least 7 days before your scheduled court date. When the request is received by the court, it is forwarded to the presiding judge at which time it is approved or not approved. You must check back with the court to obtain the judge's decision.

The duties of the presiding Municipal Court Judge include: preside over jury and bench trials; issue/ process (subpoenas, summonses, warrants, capias, capias pro fines, and attachments) to compel the attendance of persons as witnesses and parents of juveniles and to compel the appearance of defendant in municipal court; grant continuances in cases where sufficient cause is shown that a case should be postponed; conduct indigent hearings; keep and maintain a docket containing each case filed and the court action taken; rule on motions for new trials; prepare or assist in the reporting of all traffic convictions to the Texas Department of Public Safety; and serve as a magistrate of the State of Texas.

Municipal Court Prosecutor

The prosecutor is responsible for enforcing applicable state law and municipal ordinances by prosecuting all cases in which the municipal court has jurisdiction. The prosecutor's duties entail case investigation; filing charges through the preparation of complaints; discussing pending cases with defendants or their counsel; and ultimately, presenting the state's case before the court.
